Welcome to EdenPersona.com, a SaaS platform provided by Digital Nomad Family LP (company registration number: SL034590), located at 5 South Charlotte Street, Edinburgh, EH2 4AN, Scotland, United Kingdom ('EdenPersona,' 'we,' 'us,' or 'our'). By using our website, you agree to be bound by these Terms and Conditions of Sale ('TCS').

1. Service Description

EdenPersona.com is a comprehensive customer intelligence platform powered by AI that transforms how businesses understand and interact with their customers. Beyond creating buyer personas, EdenPersona offers a complete suite of marketing intelligence tools including AI-powered persona generation (Proto, Classic, and Dynamic personas), real-time chat with personas, marketing content generation through a creative assistant, CRM integrations (HubSpot, WooCommerce, Google Sheets, CSV), ROI tracking, and team collaboration through workspaces. Access to the platform is available through subscription plans (Solo, Studio, and Agency) with monthly or annual billing. Individual persona purchases are no longer available.

2. Intellectual Property

You acknowledge and agree that EdenPersona.com owns all intellectual property rights in the personas generated by the platform. However, once you have purchased or created a persona with a valid subscription, you have the right to use it for commercial purposes or for your clients without having to pay additional royalties to EdenPersona.com. You can charge your services, including the creation and use of personas, to your clients as you see fit, without us requesting rights to that. You can also create derivative works or use the personas for commercial purposes without our prior written consent.

3. Payment and Fees

Access to EdenPersona.com is available through subscription plans only. We offer three main plans (Solo, Studio, and Agency) with monthly or annual billing options. Each plan includes a specific number of personas, creative generation credits, and access to various features such as CRM integrations, workspaces, team collaboration, and white-label branding (for Agency plans). The detailed pricing and features for each subscription plan are listed on our website. You are responsible for all fees associated with your use of EdenPersona.com, and we reserve the right to change our fees at any time. If you choose to subscribe to our service, you agree to pay the subscription fees in advance, and the fees will be automatically billed to your account each month or each year (depending on your choice of subscription) until you cancel your subscription.

4. You agree not to do the following:

1. Use any automated system, including, without limitation, 'robots,' 'spiders,' 'offline readers,' etc., to access the Service in a manner that sends more request messages to the Service than a human can reasonably produce in the same period using a conventional online web browser.
2. Use the Service for illegal purposes or for the promotion of illegal activities.
3. Attempt to interfere with, compromise the system integrity or security, or decrypt any transmissions to or from the servers running the Service.
4. Take any action that imposes or may impose at our sole discretion an unreasonably or disproportionately large load on our infrastructure.
5. Upload invalid data, viruses, worms, or other software agents through the Service.
6. Collect or harvest any personally identifiable information, including account names, from the Service.
7. Use the Service to create personas that are defamatory, discriminatory, harassing, or otherwise harmful or offensive to an individual or a group.

5. Limitation of Liability

To the maximum extent permitted by applicable law, EdenPersona.com and its affiliates, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, including, but not limited to, loss of profits, data, or other intangible losses, arising out of or in connection with these TCU, the use of or inability to use the Service, or any other matter relating to the Service.

6. Modification of TCU

We reserve the right to modify these TCU at any time by posting a revised version on our website. Your continued use of the Service after the effective date of the revised TCU constitutes your acceptance of the revised TCU.

7. Applicable Law and Jurisdiction

These TCU shall be governed by and construed in accordance with the laws of Scotland, without giving effect to any principles of conflicts of law. Any dispute arising out of or in connection with these TCU or the Service shall be brought exclusively before the courts of Scotland, and you consent to the jurisdiction of these courts.

8.1 Data Retention

• Account data: Duration of contract + 3 years (limitation period)
• Personas: Duration of contract + 1 year
• Payment data: 10 years (accounting obligations)
• Usage logs: 12 months maximum

8.2 International Transfers

We use third-party services located outside the EU:

• OpenAI (USA): AI persona generation - Standard Contractual Clauses
• Stripe (Ireland/USA): Payment processing - Adequacy decision

9. Cancellation and Termination

9.1 Subscription Cancellation

You can cancel your subscription at any time:

• Via your account settings
• By email to support@edenpersona.com
• Cancellation takes effect at the end of the current billing period
• No refund for the current period (except legal right of withdrawal)

9.2 Right of Withdrawal (EU Consumers)

9.3 Account Deletion

Upon termination:

• Immediate cessation of service access
• Deletion of personas after 30 days (grace period)
• Account data retained per data retention policy
• Right to immediate deletion upon request (GDPR Article 17)
